Please take the time to read and understand the conditions of booking set out below prior to booking a trip with Holiday Organiser. We strongly recommend that you also read the Trip Notes relating to your trip prior to booking to ensure that you understand the itinerary and style of the trip you are undertaking.

In completing and submitting the Booking Form, you agree to be bound by these conditions which constitute the agreement between Holiday Organiser and you. No purported variation of these conditions will be effective unless in writing and signed by a person so authorized by Holiday Organiser Pvt Ltd.

Use of Service

Holiday Organiser is a online platform marketplace bringing together travellers and Local Travel Agencies to deliver customised or holiday package tour services to Nepal.

Any travellers who contact directly to the experts from local travel agents and agree on and accept their personalised journey.

Holiday Organiser’s duty is solely procuring a contact on the online platform. Holiday Organiser is neither a travel agent nor a tour operator. All contractual agreements in regard to the respective trip are concluded directly between the Traveler and the local Agency, based on the general terms and conditions of the local Agency where it is based in the destinations. This also applies in the event that the booking confirmation from the Agency is sent to the Traveler through the Holiday Organiser website and also in the event that the Traveler effects if the payment for the trip through the Holiday Organiser website.

Holiday Organiser does not receive any payment from the User for the service of connecting the User to a local Agency through their online platform. In the event of a mediated trip, Holiday Organiser shall, however, receive a service fee of certain percent of the travel price from the Traveller which will be disclosed in the trip offer and included in the total travel price provided the Traveler chooses to effect his payment through Holiday Organiser The service fee is due and payable when the Traveler remits his payment through Holiday Organiser.

How to Book

To reserve your place on one of the trips, please complete the Booking Form and send it, together with a non-refundable deposit of €200 per person to our bank account.

Payment

The prices quoted in this websites are for payment by credit cards, debit cards, cash, check, money order or credit charge (the latter subject to surcharge). The balance of the trip price is payable to Holiday Organiser in Nepal 60 days prior to your departure date. Unless otherwise specified, prices are quoted in Euro and Dollar and all payments must be made in either Euro or Dollar as quoted in the our website. The services to be provided are those referred to in your booking confirmation invoice sent to you by local agency through Holiday Organiser.

The payment must be transfer directly to the local Bank in Nepal as mentioned in our booking form and Bank transfer fees must be covered by the traveller.

Validity

Dates, itineraries and prices are valid from 01 January 2019 until 31 December 2019. Beyond 31 December 2019 dates, itineraries and prices are indicative only.

Acceptance of Booking and Final Payments

Acceptance of your booking will be confirmed by us in writing. Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the trip price is due 60 days before the departure date. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled. A late fee may be applied due to additional costs of confirming last minute arrangements.

Amendments / Transfers Amendments

If you wish to make amendments to your trip arrangements, you must notify Holiday Organiser in writing 60 days prior to the departure date. Each amendment to your trip arrangements will incur €100 for trekking & tour as an administration fee. All administration fees must be paid before departure.

Transfers

If you wish to transfer from one trip to another, you must notify Holiday Organiser in writing. Once we receives your notice the transfer will take effect subject to the following. The following transfer charges will apply:

  • If your notice is received more than 60 days prior to your original departure date, no transfer fee will apply. But any increase in airfares or operational services will be payable by you: or
  • If your notice is received after 60 days prior to your original departure date, a 0 transfer fee will apply. In addition, any increase in airfares or operational services will be payable by you: or
  • No transfer notice accepted that received within or less than 30 days prior to departure.

Your details

In order for us to confirm your travel arrangements you must provide all requested details with the balance of the trip price. Necessary details include full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. If you are 70 years of age or over we also require you to complete and forward a Self-Assessment form. Your booking cannot be confirmed without provision of these details.

Cancellation by the traveller

If you cancel some or all portions of your booking, cancellation fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation. If you cancel a trip:

  • 60 days or more prior to departure, we will retain the deposit
  • Between 30 and 59 days prior to departure, we will retain the deposit or 50% of the total booking cost; whichever is greater, and
  • Less than 30 days prior to departure, we will retain 100% paid by you in connection with the booking.

Note: More lenient cancellation conditions may apply to some Short Break Adventures, Urban Adventures and additional services - please ask your booking consultant for details. Different fees may apply to airline tickets depending on the carrier being used. You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation fees.

If you leave a trip for any reason after it has commenced we are not obliged to make any refunds for unused services.

Cancellation, Postponement or Delays by Us

We may cancel a trip at any time prior to departure if it is necessary to do so due to inclement weather, snow or icy conditions or conditions that are otherwise likely to be hazardous or dangerous or due to any other adverse or threatening conditions whether political or military or terrorist or otherwise or if, in the absolute discretion of Holiday Organiser, there is a likelihood of any such event occurring which may impact upon the safety of the participants, or if an act or omission of a third party prevents the tour or the aspect of the tour being undertaken in accordance with your booking. In the event of any change, modification, cancellation, postponement or delay under this condition, you acknowledges that you will have no right of refund of the tour price (whether in whole or in part) and no right to claim compensation for any injury, loss or damage or other additional expenses incurred by virtue of the change, modification, cancellation, postponement or delay. Holiday Organiser also reserves, in its absolute discretion, the right to cancel any tour due to any government travel warning or advice, or any change in such warning or advice.

Insolvency Security:

We want your holiday to be worry free from the planning stage until you return home; the last thing we want is for anything to go wrong! Therefore, for your peace of mind, all of your trips will be covered by Europäische Reiseversicherung ag In the unlikely event that something does happen to your chosen agency (for example the insolvency of the agency) we have a network of over Dozen of agencies that are ready to step in and offer you an identical (or really similar!) replacement trip. But most of the tours are not international flight inclusive and incase of insolvency of international Airline, it will be your own risk to arrange another Airlines flight ticket fly back home or vice versa. We recommend you to organise yourself due to the service not included or organised by Holiday Organiser.

We, or the suppliers of the services you have bought, will use reasonable skill and care to provide you with the services you have bought (or a suitable alternative). In some cases, where neither we nor the supplier are able to do so for reasons of insolvency or for reasons we could not reasonably foresee or forestall, an alternative Europäische Reiseversicherung ag may provide you with the services you have bought or a reasonably suitable alternative (at no extra cost to you). You agree to accept that in those circumstances the alternative Europäische Reiseversicherung ag holder will perform those obligations and you agree to pay any money outstanding to be paid by you under your contract to that alternative the holder. However, you also agree that in some cases it will not be possible to appoint an alternative Europäische Reiseversicherung ag holder, in which case you will be entitled to make a claim under the Europäische Reiseversicherung ag scheme (or your credit card issuer where applicable)

Financial Protection

For the protection and trust of our customers most of all our trips are financial protected by TRUSTEDSHOP. You are purchasing only our travel tour or trekking tour services except the international airline services. In case, if unlikely event happens of the services organised by us, we will arrange to refund any money you have paid to us for an advance booking. Travel Insurance

Travel insurance is compulsory for all travellers and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$ 200,000for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide proof of your travel insurance on the first day of your trip; you will not be able to join the trip without it. If you obtain travel insurance through us you acknowledge that you are satisfied with the level of insurance we have arranged.

Prices surcharge

Our trip prices are based on currency exchange rates as at September 2018. We reserve the right to impose surcharges up to 60 days before departure due to unfavourable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances we will be responsible for the first 2% of the additional costs and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. We will not surcharge any booking for travel within the validity of this brochure once paid in full.

Assumption of Risk

You acknowledge that:

  • By the very nature of trip, if you are travelling in the very remote areas which might be are more challenging and demanding with a commensurately higher level of risk than conventional holidays; and in the countries and regions in which trip is undertaken, standards of accommodation, transport, health care, hygiene, safety and service provision generally are often not as high as those standards in your country of residence and may require flexibility and patience on your part; and operational control of the tour may be in the hands of a third party and that your right of action in regard to any shortcomings of that third party's performance is against the third party and not against, and
  • The additional dangers and risks associated with adventure travel may include difficult and dangerous terrain; high altitude; extremes of weather, including sudden and unexpected changes; political instability; remoteness from normal medical services and from communications; and evacuation difficulties in the event of illness or injury and
  • The enjoyment and excitement of trip is derived in part from the inherent dangers and risks associated with trip and that those inherent dangers and risks are a reason why you wish to undertake the trip, and
  • You have submitted your booking for the trip after giving due consideration of relevant travel information including, without limitation, any relevant information or advice given by the governments of the Department of State and that it is your responsibility to acquaint yourself that information or advice, for the above reasons you therefore accept the inherent and increased dangers and risks associated with the proposed adventure trip and the accompanying risk of injury, death or property damage or loss.

Age

Minimum: General Policy: For the majority of our tours the minimum age for children is 06 except in the trekking. All travellers under the age of 18 must be accompanied by an adult who is responsible for the child's day to day care. Please note the children under the age of 18 are not allowed for extreme trekking routes.

Maximum: General Policy: For the majority of our trips we have no upper age limit though we remind you that our trips can be physically demanding and a Self-Assessment form is required for all passengers 70 years and over.

Health and Fitness Requirements

Participants must be in good health and physical condition and are strongly advised to follow our pre-departure fitness training recommendations, where necessary. If you suffer from severe muscular, chest, heart or bronchial disorders, or if you are a severe asthmatic, or have high blood pressure, you are strongly advised against participating. Trips take place in remote areas where there is little or no access to normal medical services or hospital facilities for serious problems. Where necessary, evacuation can be prolonged, difficult and expensive. Medical and evacuation expenses will be the responsibility of the participant. Holiday Organiser reserves the right in its absolute discretion to refuse a participant the right to participate in a trip on medical or fitness grounds.

Medical Disclouser

You declare and warrant that

  • You are in good health and mental and physical fitness at the time of booking this trip.
  • You have disclosed to Holiday Organiser every matter concerning your health and mental and physical fitness of which you are aware, or ought to reasonably be expected to know, that is relevant to Holiday Organiser decision to permit you to go on the adventure trip.
  • Immediately upon any adverse change in your health or fitness that may be likely to affect Holiday Organiser decision to accept the risk of permitting you to go on the adventure trip, you will notify Holiday Organiser in writing of any such adverse change. You acknowledge that the obligation to disclose under this condition continues from the time of booking the trip through to departure and extends for the duration of the trip. If you fail to comply with the duty of disclosure in this condition and if Holiday Organiser would not have permitted you to undertake the trip, or continue participation of the trip, had you made full disclosure under this condition Holiday Organiser will not be liable, except to the minimum extent required by law, for personal injury, death or property damage or loss incurred by you.

Passport and Visas

You must carry a valid passport and have obtained all of the appropriate visas, permits and certificates for the countries in which you will visit during your trip. Your passport must be valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip; please refer to the Trip Notes for details. We are not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.

Claims and Complaints

If you have a complaint about your trip please inform your tour leader or our local Agency at the time in order that the they can attempt to rectify the matter. If satisfaction is not reached through these means then any further complaint should be put in writing to us within 30 days of the end of the tour.

Photos and Marketing

You consent to us using images of you taken during the trip for advertising and promotional purposes in any medium we choose. You grant us a perpetual, royalty-free, worldwide, irrevocable licence to use such images for publicity and promotional purposes.

Disclaimer

You accept that:

  • Holiday Organiser acts as a booking agent for third-party tour operators and accepts no liability for the acts or omissions of those third-party tour operators, and
  • Holiday Organiser will not be liable for any breach of any law by any person with whom you travel on the tour.

Instructions on withdrawal

You have the right to revoke this contract within a period of Ten days without giving reasons. The revocation period shall be Ten days from the date of conclusion of the contract. In order to exercise your right of revocation, you must inform us by email or Telephone as mentioned below.

by means of a clear declaration (eg a letter, fax or e- Mail) about your decision to revoke this contract.

In order to keep the revocation period, it is sufficient that you send the notification of the exercise of the right of revocation before the end of the revocation period.

Security of Personal Data:

Holiday Organiser selected local agencies are reputed and reliable agencies and they keep all you personal datas strictly confidential. In case of mis use of your data, Holiday Organiser will not and can not be responsible the action mis conducted by third parties.

Consequences of revocation

If you revoke this agreement, we shall have to repay you without delay and at the latest within fourteen days from the date on which the notification of your revocation of this contract has been received by us. For such repayment, we will use the same means of payment you have used in the original transaction, unless you have expressly agreed otherwise; In no case will you be charged for these repayment fees.

If you have requested that the services be commenced during the period of revocation, you shall pay us a reasonable amount equal to the proportion of the services already provided to us by the exercise of the right of revocation with respect to this contract Comparison with the total scope of the services provided for in the contract.

Jurisdiction

Holiday Organiser Pvt. Ltd. Is registered under the Government of Kathmandu Nepal and any disputes in connection with a trip or these Booking Conditions must be initiated in the courts of Kathmandu Nepal. Holiday Organiser office in Germany is our only representative and all our office staffs or tour experts are only representing our head office of Nepal. The representative office duties are to promote Holiday Organiser online portal, provide detail information assist and suggest to the visitors for any complication of the tour.

The visitors will book any trips of their own decision and the payment for the booking the tour will be paid directly to head office Bank in Nepal.

Therefore the tour experts in Germany will not bear any kind of legal or financial responsibilities of the clients before or after their service provided by Holiday Organiser.

Therefore, this agreement and the rights and obligations of the parties will be construed and take effect in accordance with and be governed by the laws of Nepal.
